These Terms of Service ("Terms") govern your use of the Lézé mobile application (the "Service") operated by Lézé ("we," "us," or "our"). End-user Service features are provided in the mobile application. The website (leze.app) provides service information, the Terms and Privacy Policy, account deletion, and limited account-support features such as sign-in. The Service is governed by the laws of the Republic of Korea and is offered to residents of the Republic of Korea, the United States, the United Kingdom, Canada, Australia, and Japan (collectively, the "Designated Countries"). The supported languages are Korean and English. Users whose primary language is neither Korean nor English (including residents of Japan) may use the English interface at their own discretion. The Service is not offered to residents outside the Designated Countries. By using the Service, you agree to these Terms.
1. Service Description
Lézé is an AI-powered wine cellar management mobile application. End-user Service features are provided in the mobile application; the website provides limited account-support features such as sign-in. Features include wine label scanning, building a personal wine cellar, AI-generated wine profiles and recommendations, recording tasting notes, saving wine memories, planning dinners around your wine collection, discovering wine-friendly restaurants (Lézé Table), hosting tasting sessions and wine groups, following other users, sending direct messages (DMs), and participating in the Community (Wine Bar).
2. Account Registration
Accounts are created with a valid email address or social login (Apple, Google). End-user Service features are provided in the mobile application. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The Service is offered only to residents of the Designated Countries. By creating an account you self-attest that (i) you reside in one of the Designated Countries, and (ii) you meet the legal drinking age applicable to your country of residence. The Service is an informational wine-cellar application; we do not sell, ship, deliver, or facilitate the sale of any alcoholic beverage, and we therefore do not automatically verify the country-specific legal drinking age listed below — we rely on your self-attestation. At sign-up we automatically enforce only the U.S. Children's Online Privacy Protection Act (COPPA) minimum of 13 years and the Korean Personal Information Protection Act (PIPA) minimum of 14 years. For reference, the legal drinking age by country of residence is: - Republic of Korea: 19 years or older (Youth Protection Act) - United States: 21 years or older in every state (National Minimum Drinking Age Act, 23 U.S.C. §158) - United Kingdom: 18 years or older - Australia: 18 years or older - Canada: 18 years or older (Quebec, Alberta, Manitoba) or 19 years or older (other provinces) - Japan: 20 years or older We may suspend or terminate, without prior notice, any account that we reasonably believe does not meet the residency or self-attested age requirement, and we are not liable for any data loss resulting from such action. Any legal disputes or damages arising from misrepresenting your residence and using the Service from outside the Designated Countries are solely your responsibility.
3. Free and Premium Plans
3.1 Free Plan
The free plan applies usage limits to certain features, including label scans, cellar storage, AI sommelier conversations, and wine data collection, and displays advertisements. The specific limit for each feature is published on the plan information screen in the application and may change as the Service is operated. If a usage limit is changed in a way that is unfavorable to you, we will announce the change in the application before it takes effect.
3.2 Premium Plan
The Premium plan provides paid benefits such as expanded or relaxed usage limits and an ad-free experience compared to the free plan. The specific benefits and limits are published on the subscription screen shown before purchase and on the plan information screen in the application. The composition of benefits and limits may also change as the Service is operated; if a change is unfavorable to you, we will announce it in the application before it takes effect, and if you do not agree with the change you may cancel your subscription at any time under Section 3.3. Premium subscriptions can only be purchased through in-app purchase in the Lézé mobile application, and Premium benefits are provided in the Lézé mobile application.
3.3 Subscription Management
Premium subscriptions are managed through RevenueCat and the app marketplace used to subscribe. Subscription billing, renewal, and cancellation are governed by the terms of that marketplace. You may manage or cancel your subscription through your device's subscription settings or the subscription menu for your account in that marketplace.
4. Acceptable Use
You agree not to: - Use the Service for any illegal purpose - Upload harmful, offensive, or inappropriate content - Attempt to gain unauthorized access to the Service or other users' accounts - Interfere with or disrupt the Service's infrastructure - Reverse engineer, decompile, or disassemble any part of the Service - Use the Service to scrape or harvest data - Create multiple accounts to circumvent usage limits
5. Community (Wine Bar) and Direct Message (DM) Guidelines
The Community (Wine Bar) is a space for users to connect over wine, and Direct Messages (DMs) provide private one-to-one conversations between users. You must follow these guidelines in both surfaces: - Do not post or send spam, promotional content, or commercial solicitations - Do not post or send content that insults, harasses, threatens, or otherwise abuses others - Do not spread misinformation or engage in phishing or fraud - Do not impersonate others - Do not post or send inappropriate or explicit content You can set your DM reception policy to 'Anyone', 'My followers', or 'Mutual follows only', and you can use the block feature to hide a user's posts and block their DMs. We may hide or remove content that violates these guidelines without prior notice, and posts with accumulated reports may be automatically hidden. Reported DMs are reviewed only to the extent necessary to handle the report or to meet legal obligations; confirmed violations may result in DM restrictions, restricted community access, or account suspension.
6. AI-Generated Content
Wine profiles, tasting notes, food pairing suggestions, sommelier recommendations, and other AI-generated content are provided for informational purposes only. AI outputs may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Always verify critical information such as allergen data independently.
7. User Content
You retain ownership of content you create within the Service, including tasting notes, ratings, photos, personal records, community posts and comments, and direct messages. By uploading content, you grant us a limited license to store, process, and display it within the Service as necessary to provide you the functionality you expect. Content posted to the Community is shown to other users according to your profile and cellar visibility settings, while direct messages are treated as private content readable only by the sender and recipient. You may export and delete your data at any time.
8. Advertising
Ads are displayed inside the mobile application for free plan users. Ads are served through Google AdMob. Upgrading to the Premium plan removes all ads.
9. Intellectual Property
The Service, including its design, code, AI models integration, and branding ("Lézé"), is our intellectual property. You may not copy, modify, or distribute any part of the Service without our written permission.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for: - Inaccuracies in AI-generated wine information - Loss of data due to service interruptions - Decisions made based on wine recommendations or food pairing suggestions - User-generated content (UGC) posted on the Community (Wine Bar) or sent via Direct Messages — under 47 U.S.C. § 230, we are not treated as the publisher or speaker of third-party content, and under § 230(c)(2)(A) (the "Good Samaritan" provision) we are not liable for any moderation or removal action we take in good faith with respect to content we consider objectionable. - Any indirect, incidental, consequential, or punitive damages Our total aggregate liability is limited to the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) USD 100. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability; in those jurisdictions, this Section applies to the maximum extent permitted by applicable law.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time through the app (Settings > Delete Account), on the web (leze.app/delete-account), or by contacting bzr.studio.ko@gmail.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to These Terms
We may modify these Terms. Every revision is published in the 'Revision history' section at the bottom of these Terms, together with its effective date and a before/after comparison; we may additionally announce material changes in the app or by email. These Terms are a contract between you and us, so a revised version applies to you from the moment you accept it. The first time you open the app after a revision takes effect, you will see a summary of what changed together with an acceptance screen, and use of the Service is paused until you accept. If you do not wish to accept, you can sign out from that screen and may terminate (delete) your account at any time under §11. We record and retain which version of the Terms and Privacy Policy you accepted and when.
13. Governing Law, Dispute Resolution, and Class Action Waiver
13.1 Governing Law. These Terms are governed by the laws of the Republic of Korea. For users residing in the United States, the Federal Arbitration Act governs the interpretation and enforcement of Sections 13.2–13.6 below, and the substantive laws of the State of California (without regard to conflict-of-laws principles) apply to all other matters. 13.2 Informal Resolution. Before filing any claim, you agree to first contact us at bzr.studio.ko@gmail.com and attempt to resolve the dispute informally for at least 60 days. 13.3 Binding Individual Arbitration (US residents only). Any dispute not resolved informally shall be finally resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in San Francisco, California, in English. Either party may bring an individual action in small-claims court for qualifying claims. 13.4 Class Action Waiver (US residents only). YOU AND LÉZÉ AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING OR ARBITRATION. 13.5 30-Day Opt-Out (US residents only). You may opt out of Sections 13.2–13.4 by emailing bzr.studio.ko@gmail.com within 30 days of account creation, with subject "Arbitration Opt-Out" and your account email. Opting out does not affect any other Term. 13.6 Korea and Other Designated Country Jurisdictions. For users residing outside the United States (Republic of Korea, United Kingdom, Canada, Australia, Japan), all disputes arising out of or relating to these Terms shall be resolved exclusively in the Seoul Central District Court of the Republic of Korea. 13.7 Severability. If any provision of Sections 13.2–13.4 is held unenforceable, the remainder of Section 13 shall remain in full force. If the Class Action Waiver in Section 13.4 is held unenforceable, Sections 13.2–13.3 shall also be void and the dispute shall proceed in court under Section 13.6.
14. Copyright Infringement Notices (DMCA Notice and Takedown)
We follow the safe-harbor procedures of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content posted on the Service (label photos, community posts, comments, etc.) infringes your copyright, please send a notice containing the following to bzr.studio.ko@gmail.com (subject: "DMCA Notice"): 1. The signature (electronic is acceptable) of the copyright owner or authorized agent. 2. Identification of the copyrighted work claimed to be infringed. 3. Identification of the infringing material and its location (URL, post ID, etc.). 4. The complainant's contact information (address, phone, email). 5. A statement that the complainant has a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law. 6. A statement made under penalty of perjury that the information is accurate and that the complainant is the rights owner or authorized to act on its behalf. We will, within a reasonable time after receipt, remove or disable access to the allegedly infringing material and notify the poster, who may submit a counter-notice under 17 U.S.C. § 512(g). Accounts of repeat infringers may be suspended or terminated.
15. Auto-Renewal and Billing Terms
Premium subscriptions automatically renew at the price and frequency disclosed at purchase (monthly or annual). The app marketplace used to subscribe may charge your account within 24 hours before the end of the current billing period. To avoid renewal, cancel at least 24 hours before the end of the current period through your device's subscription settings or the subscription menu for your account in that marketplace. Cancellation takes effect at the end of the current billing period; no partial refunds are issued except where required by law. Free trials, when offered, automatically convert to paid subscriptions unless canceled before the trial ends. California residents: Under the California Automatic Renewal Law (Bus. & Prof. Code § 17602), you may cancel online at any time through the same channel used to subscribe (the app marketplace used to subscribe). UK residents: In accordance with the Digital Markets, Competition and Consumers Act 2024 (DMCC Act 2024), we provide sufficient pre-contract information at subscription and do not impede the cancellation process. Cancellation can be performed through the subscription settings of the app marketplace used to subscribe. Canada, Australia, and Japan residents: Your local consumer-protection laws provide cancellation and refund rights, exercised through the subscription settings of the app marketplace used to subscribe.
